Terms of Service & Liability Release
Calloway Diagnostic Solutions, LLC | Effective Date: October 2026
1. General Agreement & Authorization
By engaging Calloway Diagnostic Solutions, LLC for diagnostic, maintenance, or repair services, the customer (“Customer”) agrees to these terms and conditions. The Customer authorizes Calloway Diagnostic Solutions, LLC to perform requested repair work and grants permission to operate the vehicle on public roads or elsewhere for testing and inspection.
2. Mobile Service & Property Authorization
Because Calloway Diagnostic Solutions, LLC operates as a mobile repair service, the Customer guarantees they have legal right, ownership, or explicit permission from the property owner, property management, or Homeowners Association (HOA) for automotive or heavy equipment repairs to be performed at the designated location.
- Liability Release: The Customer agrees to hold Calloway Diagnostic Solutions, LLC harmless against any fines, towing fees, complaints, or legal actions resulting from unauthorized repairs on the premises.
- Safe Working Environment: The Customer must provide a safe, reasonably level surface. We reserve the right to refuse service if the location poses a safety hazard.
3. Dispatch Fees, Labor Rates, & Estimates
- Pre-Paid Dispatch Fees (Non-Refundable): A dispatch fee is required to secure any mobile service appointment. This fee covers travel to the location and the initial diagnostic period. The dispatch fee must be paid in full in advance and is strictly non-refundable. If the Customer cancels, is not present, or the vehicle is inaccessible, the dispatch fee is forfeit.
- Labor Rates: Further labor beyond the initial diagnostic period is billed incrementally based on vehicle type (Automotive vs. Diesel/Ag/Heavy Equipment).
- Estimates vs. Actual Costs: Repair estimates are provided in good faith. If additional labor or parts are required beyond the original estimate, the technician will pause work and require customer authorization before proceeding.
4. Payment Terms
While the dispatch fee is paid in advance, payment for all remaining parts and labor is due in full immediately upon completion of authorized services. Accepted payment methods include Cash, Zelle, and Credit/Debit Card. Vehicles or equipment will not be released until the final invoice is paid in full.
5. Older Vehicles (5+ Years) & Modified Equipment — Waiver of Liability
Due to natural material degradation, Calloway Diagnostic Solutions, LLC is not responsible or liable for incidental or unavoidable damage that may occur during inspection, diagnosis, or repair of vehicles older than five (5) years, or vehicles equipped with non-OEM modifications.
- Scope of Exemption: Includes, but is not limited to, breaking of brittle interior/exterior plastics, snapping of rusted/seized fasteners, failure of degraded coolant/vacuum hoses, and crumbling of old wiring harness connectors.
- Release of Warranty: The Customer explicitly releases all liability and completely forgoes any warranty associated with repairs or parts provided on said older or modified vehicles.
- Cost Adjustments: The Customer acknowledges that repair estimates may increase if unforeseen complications (such as extracting broken bolts) arise during disassembly.
6. Pre-Existing Conditions & Dashboard Teardowns
Prior to beginning major electrical repairs, A/C evaporator replacements, or dashboard removals, the technician may perform a pre-scan of vehicle modules. Calloway Diagnostic Solutions, LLC is not responsible for pre-existing diagnostic trouble codes (DTCs), warning lights (including SRS/Airbag lights), or pre-existing broken trim pieces.
7. Customer-Supplied Parts Policy
If the Customer insists on supplying their own replacement parts, Calloway Diagnostic Solutions, LLC offers NO WARRANTY on the repair. If a customer-supplied part fails or is defective, the Customer remains fully responsible for all labor charges incurred.
8. Right to Refuse Service
Calloway Diagnostic Solutions, LLC reserves the right to refuse service to any vehicle deemed unsafe to work on (e.g., severe frame rust, biological hazards, unsafe modifications) or in situations involving a hostile work environment.
